Consultation Call Form

For all custom work related consultation it's required to record the session so we can provide accurate quote. The recording will be made available for you for reference after the call. After the call let us know if you would like the recording to be deleted.

Authorization:
You are engaging ListingProWP (directly or an authorized partner), as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorize ListingProWP (directly or an authorized partner) access and “write permissions” to all directories and files of your account with any other third party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.

Pricing & Payments:
Payment must be made in full before the services begin unless it is agreed upon to proceed with different terms.

Cancellation:
Cancellation of the service is not possible after the work has been started or delivered. Full payment must be made and no refunds are available.

Third Party or Client Page Modification:
You acknowledge that you or your staff have access to independently edit or update web pages within the WordPress platform.

You also acknowledge that anyone other than ListingProWP or its authorized subcontractors who attempt to update the website and damage the design or impairs the ability for the web pages to display or function properly, then we are not responsible. Unless it’s discussed and agreed upon it may result in time to repair the web pages in order to restore the website.

In this event, damages will be assessed at an hourly rate of $50 (USD) per hour with a one-hour minimum. Work to repair the website from third-party modifications is outside of the support time and scope of this project.

Limitation of Liability; Disclaimer of Warranties:
Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. Please read and understand our limits of liability before engaging in our services.

Although we strive for your website’s optimal performance and security, we did not build the WordPress software or plugins used on the website, nor are supplying the hosting platform it runs on.

For this reason, ListingProWP (directly or an authorized partner) does not represent, guarantee or warrant that the functions contained in these web pages or internet website will be will be uninterrupted, error-free, free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and ListingProWP (directly or an authorized partner) disclaims any liability relating thereto.

To the extent not prohibited by law, in no event will ListingProWP (directly or an authorized partner) be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, however caused, even if ListingProWP (directly or an authorized partner) has been advised of the possibility of such damages.

Copyright:

ListingProWP (directly or an authorized partner) does not assume any responsibility or liability for the content of the website it manages, maintains and/or hosts.

Supply of Materials:
The Client is to supply all materials and information required for ListingProWP (directly or an authorized partner) to complete the work in accordance with the Client’s request. Such materials may include, but are not limited to, photographs, text content, logos and other printed materials. Where the Client’s failure to supply such materials leads to a delay in completion of the work, ListingProWP (directly or an authorized partner) has the right to extend the previously agreed deadlines for the completion of the work by a reasonable amount. Where the client’s failure to supply materials prevented progress on the work for more than 2 days, ListingProWP (directly or an authorized partner) has the right to terminate the contract.

Right to Assign:
While the Client is a customer of ListingProWP and has an agreement the Client must not assign work to a third party without prior written consent from ListingProWP.

Should you transfer ownership of the website, or as part of a transfer of ownership of business then the new owners will need to come to a new agreement with ListingProWP.

Third Parties:
ListingProWP (directly or an authorized partner) can take no responsibility for services provided by third parties through us or otherwise.

Search Engine Listings:
ListingProWP does not guarantee listings on search engines and the client accepts that it is search engines and not ListingProWP (directly or an authorized partner) who determine whom they list and whom they will not. The Client further understands there is no guaranteed placement or rank on the search engines and that a new website may never appear on search engines. ListingProWP (directly or an authorized partner) does not control search engine algorithms and huge shifts can appear daily, weekly, and even hourly.

Acceptance:
Please note that by accepting this proposal, you are agreeing to all of our terms of service as they are written here. ListingProWP reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of his or her organization or business.
